Terms of Service

These Terms of Service ("Terms") govern your use of the CutClub website at www.cutclub.com.au and the lawn care services provided by GroundUp Creative Co. (ABN 55 997 349 055), trading as CutClub. By booking a service or using our website, you agree to these Terms. Please read them carefully.

1. About us

CutClub is a lawn care subscription service operated by GroundUp Creative Co. (ABN 55 997 349 055), based in Spring Farm, New South Wales, Australia. We provide residential lawn mowing and maintenance services in the Macarthur region of NSW.

2. Services

CutClub provides lawn mowing and associated garden maintenance services on a one-off or recurring subscription basis (fortnightly, every 3 weeks, or monthly). The specific services included in each visit are as described in your quote.

All quotes are estimates based on the information you provide (property address, lot size, grass height). The final price may vary if conditions at the property differ materially from those described. We will notify you of any price adjustment before proceeding.

We reserve the right to decline a booking or cancel a service at our discretion, including where access to the property is unsafe, the property is unsuitable for our equipment, or where a customer has an outstanding unpaid balance.

3. Bookings and appointments

Bookings are confirmed once payment has been processed (for one-off services) or a valid payment method has been saved (for subscription services). You will receive a confirmation email with your appointment details.

You are responsible for ensuring the property is accessible on the day of service (e.g. gates unlocked, pets secured, obstacles removed from the lawn area). If we are unable to access the property at the scheduled time, the visit may be forfeited and charged in full.

You may reschedule an appointment using the link in your confirmation email, subject to availability, provided you do so at least 24 hours before the scheduled time.

4. Pricing and payment

All prices are quoted in Australian dollars (AUD) and include GST where applicable. Payments are processed securely via Stripe. We accept major credit and debit cards.

For subscription customers, your payment method will be charged automatically at the frequency you selected (fortnightly, 3-weekly, or monthly). You authorise CutClub to charge your saved payment method for each billing cycle.

If a payment fails, we will notify you and attempt to collect payment again. Continued failure to pay may result in suspension or cancellation of your subscription.

5. Cancellations and refunds

One-off services: You may cancel a one-off booking for a full refund provided you cancel at least 24 hours before the scheduled appointment. Cancellations made within 24 hours of the appointment may be charged in full.

Subscription services: You may cancel your subscription at any time by visiting www.cutclub.com.au/manage or by contacting us at [email protected]. We require a minimum of 14 days written notice before your next billing date. Cancellations made with less than 14 days notice will be charged for the next billing cycle.

Refunds will be processed to your original payment method within 5–10 business days. Refunds are not available for services that have already been completed.

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including your rights to a remedy for services that are not provided with due care and skill or are not fit for purpose.

6. Our liability

We will perform all services with reasonable care and skill. If we cause damage to your property during a service, please notify us within 48 hours and we will work with you to reach a fair resolution.

To the extent permitted by law, our liability for any loss or damage arising from our services is limited to the amount paid for the service in question. We are not liable for indirect, consequential, or economic loss.

Our services come with guarantees under the Australian Consumer Law that cannot be excluded. Where a service is not provided with due care and skill, you are entitled to have the problem fixed or to receive a refund.

7. Your responsibilities

You agree to:

  • Provide accurate information when requesting a quote or booking
  • Ensure safe access to your property on the day of service
  • Keep your payment details up to date for subscription services
  • Not use our website or services for any unlawful purpose

8. Intellectual property

All content on the CutClub website, including text, images, logos, and software, is owned by or licensed to GroundUp Creative Co. and is protected by Australian copyright law. You may not reproduce, distribute, or use any content without our prior written permission.

9. Website use

We do not guarantee that our website will be available at all times or free from errors or viruses. We reserve the right to modify or discontinue any part of the website at any time without notice.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, without prejudice to your rights under the Australian Consumer Law.

11. Changes to these Terms

We may update these Terms from time to time. The current version will always be available at www.cutclub.com.au/terms. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
